Delivering judgment on Thursday, March 6, 2026, Justice James Omotosho ruled that the prosecution failed to present sufficient evidence to link the defendants to the disputed properties in Abuja, Maiduguri, and Borno State. The judge described the NDLEA’s case as “watery” and lacking credible proof.

Justice Omotosho also criticised the inclusion of Kyari’s brothers in the conspiracy charge, describing it as “unsubstantiated and in bad faith.” He held that no prima facie case was established against any of the defendants.
The court found no evidence connecting DCP Abba Kyari or his brothers to ownership or control of the properties listed in the charge sheet.
The prosecution’s reliance on circumstantial evidence and assumptions was deemed insufficient to sustain the allegations.
The ruling applies solely to the asset declaration and conspiracy counts. Separate drug-related charges against Kyari (including alleged links to international drug cartels) remain pending in other courts.
The NDLEA filed the 23-count charge in 2022, accusing Kyari once celebrated as a top anti-drug officer of failing to declare assets acquired during his service, including high-value properties allegedly purchased with proceeds of crime. The case formed part of a broader probe into Kyari following his 2022 suspension over alleged ties to drug baron Ramon Abbas (Hushpuppi).
Kyari and his brothers pleaded not guilty when arraigned. The trial faced multiple adjournments amid legal challenges and the defendants’ detention periods.

The acquittal does not affect Kyari’s suspension from the Nigeria Police Force or his ongoing trial in the U.S.-linked drug case before another court.
