Former Kaduna State Governor, Nasir El-Rufai, is set to file a no-case submission in his ongoing trial for alleged unlawful interception of communications and breach of national security.

The Department of State Services (DSS) formally closed its case against him on Tuesday at the Federal High Court in Abuja after deciding not to call any further witnesses.

The DSS is prosecuting El-Rufai on an amended five-count charge bordering on alleged wiretapping. The charges stem from claims he made during a live interview on Arise Television in February, where he alleged that he had intercepted a telephone conversation involving the National Security Adviser, Nuhu Ribadu, revealing plans to arrest him.

Counsel to the DSS, Oluwole Aladedoye, informed the court of the closure of the prosecution’s case.

In response, El-Rufai’s lead counsel, Paul Erokoro (SAN), announced that the defence would file a no-case submission, arguing that the prosecution failed to establish sufficient evidence to warrant the former governor entering a defence.

Erokoro sought two weeks to file the application, while the prosecution requested another two weeks to respond.

The defence also applied for a variation of the stringent bail conditions earlier granted to El-Rufai, describing them as difficult to fulfil. However, Justice Joyce Abdulmalik declined the request, ruling that qualified sureties exist.

The court adjourned the matter to September 22, 2026, for the filing of the no-case submission and continuation of proceedings.

The development marks a significant stage in the high-profile case involving the former governor, who has maintained his innocence throughout the trial.
