A Federal High Court in Abuja on Friday, February 27, 2026, granted bail to former Attorney-General of the Federation Abubakar Malami (SAN) and his son Abdulaziz Malami in the sum of ₦200 million each over a five-count charge bordering on alleged terrorism financing and illegal possession of firearms.
Presiding Justice Joyce Abdulmalik ordered the defendants to produce two sureties each in like sum, with one of the sureties required to provide the title deed of a developed property located in either Asokoro or Maitama, Abuja.

The court also directed the defendants to deposit their international passports with the court registry as part of the bail conditions.
The Department of State Services (DSS) accused Malami of knowingly abetting terrorism financing by allegedly refusing to prosecute suspected terrorism financiers whose case files were forwarded to the Office of the Attorney-General for prosecution, contrary to Section 26(2) of the Terrorism (Prevention and Prohibition) Act, 2022.

The DSS further alleged that Malami and his son unlawfully possessed a Sturm Magnum 17-0101 firearm, 16 live rounds of Redstar AAA 5’20 cartridges, and 27 expended cartridges at their residence in Birnin Kebbi, Kebbi State, without a licence an offence said to amount to preparing to commit an act of terrorism, contrary to Section 29 of the same Act. Both defendants pleaded not guilty to all five counts when the charge was read to them.
Prosecution counsel A.U. Igwe informed the court that the case file had been transferred to the Department of Public Prosecution (DPP) for further handling.

Defence counsel Joseph Daudu (SAN) had urged the court to grant bail on liberal terms, citing the defendants’ previous compliance with bail conditions in related EFCC matters and their status as responsible citizens.

After hearing arguments, Justice Abdulmalik granted the bail but imposed strict conditions, including the property title deed requirement and passport deposit.

The matter was adjourned to March 4, 2026, for hearing. Malami’s Legal Team Reaction Malami’s lawyers welcomed the bail ruling but criticised the stringent conditions, describing them as “excessive and punitive” given the nature of the charge and the defendants’ antecedents.
The former AGF has consistently denied all allegations, describing them as politically motivated attempts to silence his criticism of the current administration.
