The Federal High Court in Abuja has thrown out an urgent ex-parte application filed by detained IPOB leader Nnamdi Kanu seeking immediate transfer from Sokoto Maximum Security Correctional Centre to any custodial facility in the Federal Capital Territory or neighbouring Nasarawa State.
Justice Binta Nyako, presiding over Kanu’s long-running terrorism trial, declined the motion on Monday morning, ruling that the application was “premature and incompetent” because the Nigerian Correctional Service (NCoS) the proper respondent was not joined as a party.
Kanu’s lead counsel, Aloy Ejimakor, had argued that the 1,200-kilometre distance from Sokoto to Abuja severely hampers legal consultations, family visits, and preparation for his pending appeal against the life sentence handed down on November 20. Ejimakor described the Sokoto posting as “punitive, oppressive and calculated to break his spirit.”

Justice Nyako, however, held that any complaint about place of incarceration must be directed at the Controller-General of Corrections through a properly filed suit with all necessary parties. She directed Kanu’s team to refile correctly if they wished to pursue the matter.
The ruling is the latest setback for Kanu, who was secretly moved to Sokoto on November 21 one day after receiving a life sentence on four counts of terrorism. Supporters have called the transfer a deliberate attempt to isolate him from Igbo land and limit access to lawyers and family.
Reacting outside the courtroom, Ejimakor vowed to refile immediately with NCoS joined, stating:
“We will not rest until our client is brought closer to his people and his legal team. Keeping him in Sokoto is cruel and unusual punishment.”
No date has been fixed for the next hearing in Kanu’s substantive appeal against the life sentence, which his team says will be taken straight to the Supreme Court.
