As 2027 election talk intensifies, a new lawsuit is questioning whether former President Goodluck Jonathan can legally run for president again, setting up a potential constitutional showdown despite earlier court rulings affirming his eligibility.

The suit, marked FHC/ABJ/CS/2102/2025, was filed before the Federal High Court in Abuja by lawyer Johnmary Jideobi. It seeks a declaration that Jonathan is ineligible to contest for president again, arguing that he has already taken the presidential oath twice — first in May 2010 following the death of President Umaru Musa Yar’Adua, and again in May 2011 after winning the presidential election.

The plaintiff contends that these two oaths constitute the constitutional limit, and that allowing Jonathan to contest in 2027 would violate Section 137(3) of the 1999 Constitution, which bars anyone from being elected president more than twice.

The legal challenge comes as Jonathan’s name continues to surface in 2027 political conversations, with supporters urging him to consider a return to the ballot.

However, precedent appears to favor Jonathan. In 2013, 2015, and 2022, Nigerian courts ruled that Jonathan remains constitutionally eligible to run for president. The 2015 and 2022 judgments specifically addressed the two-oath argument, with courts holding that his first term, which began in 2010 to complete Yar’Adua’s tenure, did not count as a full elected term under the constitutional two-term limit.

Legal analysts say the new suit will likely test how the courts interpret Section 137(3) in light of those previous judgments. The Federal High Court in Abuja is yet to fix a date for hearing.
