A Federal High Court in Abuja has issued a sweeping injunction restraining the Peoples Democratic Party (PDP) from proceeding with its 2025 National Convention scheduled for November 15-16 in Ibadan, Oyo State, throwing the opposition party’s leadership transition into disarray amid escalating internal crises.

Justice James Omotosho, delivering judgment in suit FHC/ABJ/CS/1803/2024 on Friday, ruled that the PDP failed to meet mandatory legal prerequisites for the convention, including conducting ward, local government, and state congresses in at least 14 states as required by the Electoral Act 2022 and the party’s constitution. The court also barred the Independent National Electoral Commission (INEC) from monitoring, receiving, publishing, or recognizing any outcomes from the event until full compliance is achieved.

“The PDP’s non-adherence to these provisions renders the planned convention invalid and a nullity,” Justice Omotosho declared, citing evidence from INEC and other respondents that showed no congresses were held in key states like Imo, Abia, and several in the South-South. He further invalidated notices issued by National Chairman Umar Iliya Damagum without the countersignature of National Secretary Samuel Anyanwu, violating party protocols.

The suit was instituted by three aggrieved PDP members Austin Nwachukwu (Imo State Chairman), Amah Abraham Nnanna (Abia State Chairman), and Turnah Alabh George (South-South Secretary) represented by Senior Advocate Joseph Daudu. They argued that the convention’s preparation breached constitutional safeguards, urging the court to enforce INEC’s monitoring mandate under Section 85 of the 1999 Constitution.

In a related development, Justice Peter Lifu of the same court rejected an ex-parte motion by former Jigawa Governor Sule Lamido to halt the convention, ordering the PDP and INEC to show cause why his reliefs should not be granted at a hearing set for November 7. Lamido, a foundation PDP member eyeing the national chairmanship, claimed he was unlawfully denied a nomination form and that the process flouted party guidelines. His suit, marked FHC/ABJ/CS/2299/2025, sought to prohibit INEC from aiding the event until his grievances are addressed.

Bauchi Governor Bala Mohammed, a key PDP governor, led a delegation of party chieftains to court ahead of the rulings, signaling high stakes for the opposition’s unity.

The injunction exacerbates the PDP’s deepening fractures, coming weeks after the party postponed aspirant screenings on October 28 due to “unforeseen circumstances.” The convention was meant to elect new national officers, including a successor to Damagum, amid calls for restructuring to counter perceived godfatherism by figures like FCT Minister Nyesom Wike.

PDP spokesperson Deji Chutus decried the ruling as “regrettable but a call for introspection,” vowing swift remedial congresses. “We remain committed to a transparent process that unites our party for 2027,” he said. Wike allies, however, celebrated online, with #PDPInCrisis trending and posts accusing the Damagum faction of “self-sabotage.”

Analysts link the suit to broader power plays, including Lamido’s anti-Wike stance and the PDP Governors’ Forum’s August warning against derailing the convention. With Nigeria’s 33% unemployment and recent fuel duty hikes fueling discontent, the PDP’s paralysis could embolden President Tinubu’s APC ahead of off-cycle polls.

The party now faces a tight timeline: Remedial actions must precede any rescheduled event, or risk prolonged leadership vacuum. As Justice Omotosho advised, “Compliance is non-negotiable democracy demands it.”
