A Federal Capital Territory (FCT) High Court sitting in Maitama has struck out a three-count forgery charge filed by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) against senior advocate of Nigeria (SAN), Mike Ozekhome.
The ruling was delivered by Justice Peter Kekemeke on Tuesday, February 24, 2026, following an application for withdrawal moved by Rotimi Oyedepo (SAN), counsel to the Attorney-General of the Federation (AGF), who had taken over the prosecution from the ICPC.

The ICPC filed the three-count charge on January 16, 2026, accusing Ozekhome of knowingly presenting forged documents including a Nigerian international passport to support his claim of ownership of a property located at 79 Randall Avenue, London NW2 7SX, during proceedings before the London First-Tier Tribunal.
On January 26, 2026, the Office of the Attorney-General of the Federation took over the case. At the previous adjourned date, Oyedepo had assured the court that the prosecution would be conducted with “the highest standard of efficiency, effectiveness, diligence and compliance with due process of law.”

Reason for Withdrawal During Tuesday’s session originally scheduled for Ozekhome’s arraignment Oyedepo informed the court that the AGF’s office required more time to review and consolidate the issues, which cut across different investigating agencies. He argued that this step would help strengthen the case if it is to be pursued further.

Justice Kekemeke, after hearing the application, struck out the charge without prejudice to the possibility of refiling at a later date.

Mike Ozekhome (SAN): Through his media office, the senior lawyer welcomed the ruling as “a victory for the rule of law and due process.” He maintained his innocence throughout and described the charge as “malicious and politically motivated.”
AGF Office: No further comment beyond Oyedepo’s submission in court.

The striking out means the case is no longer active before the FCT High Court, though the AGF retains the option to re-file after further review and consolidation of evidence from multiple agencies.
