The Federal High Court in Abuja on Monday adjourned judgment in the asset forfeiture suit filed by the Economic and Financial Crimes Commission (EFCC) against former Attorney-General of the Federation (AGF), Abubakar Malami, SAN, and 57 properties linked to him.

Justice Joyce Abdulmalik fixed July 10 for the delivery of the judgment.
The case, which was initially scheduled for judgment on May 26, could not proceed on Monday, though no reason was given for the adjournment. Other cases on the cause list were similarly rescheduled.

The EFCC is seeking the final forfeiture of the properties, which it claims were reasonably suspected to be proceeds of unlawful activities.

During the last hearing, EFCC’s counsel, Jibrin Okutepa, SAN, urged the court to grant the motion, arguing that Malami and other respondents had “woefully failed to show cause” that the properties were acquired legitimately.

Responding, counsel to Malami and other respondents, Adedayo Adedeji, SAN, urged the court to dismiss the application.

Adedeji argued that the EFCC relied on suspicion rather than concrete evidence and that the properties, including some acquired before Malami assumed office, were not proceeds of crime.

He maintained that the court could not properly determine the matter without oral evidence.

The case has attracted significant public interest due to the high profile of the former AGF and the volume of assets involved.
Judgment is now expected on July 10.
Further details on the outcome of the suit will be reported as they unfold.
