The Federal High Court in Abuja on Wednesday granted an application by former Minister of Petroleum Resources, Diezani Alison-Madueke, seeking to present evidence of her acquittal by a UK court in her ongoing suit against the Economic and Financial Crimes Commission (EFCC).
Justice Inyang Ekwo granted the motion on notice moved by Diezani’s counsel, Godwin Iyinbor, after the EFCC did not oppose the application.

The UK’s Southwark Crown Court had on June 17 discharged and acquitted the embattled former minister of criminal allegations of bribery.
Diezani is challenging the EFCC’s move to auction or sell some of her properties through an amended originating motion marked FHC/ABJ/CS/21/2023.
When the matter came up on Wednesday, Iyinbor informed the court of the fresh development and sought leave to file a further/supplementary affidavit to bring the UK acquittal to the court’s attention.

The EFCC’s counsel, Mofesomo Oyetibo, SAN, acknowledged service of the application but described it as an attempt to waste judicial time. However, he stated that the commission was not opposing the motion.
Justice Ekwo subsequently granted the application as prayed and adjourned the matter to October 6 for hearing of both the preliminary objection and the substantive suit.
In the application, Diezani’s lead counsel, Prof. Mike Ozekhome (SAN), argued that the UK acquittal is a material subsequent event that should be placed before the court, particularly as it relates to issues of conviction, fair hearing, and the propriety of asset forfeiture.

He clarified that the application was not asking the Nigerian court to sit on appeal over the UK decision but to consider a relevant new fact in the interest of justice.
The case is part of a long-running legal battle between the former minister and the EFCC over allegations of corruption and the seizure of assets linked to her.

The EFCC is yet to issue an official reaction to the latest court development.
